Terms of Service
Plain language. Real protection. No fine print.
Last updated May 12, 2026
1. Agreement
By creating an account or using goldenhour (the “Service”), you agree to these Terms. The Service is operated by Gabriel Oleas (the “Operator” / “we”). If you don't agree, don't use the Service.
2. Eligibility + accounts
You must be at least 18 years old and operating a legitimate beauty, wellness, or related personal-services business. You're responsible for keeping your login credentials secure and for all activity under your account. One account per business.
3. What you can do with goldenhour
- Manage your bookings, services, clients, payments, and communication.
- Accept payments through Stripe (charged to your connected account).
- Send transactional SMS and email to your clients via our Twilio + Resend integrations.
- Export your client list, appointments, and messages at any time.
4. What you can't do
- Send unsolicited marketing or spam to anyone. The SMS channel is for transactional appointment-related messages only (10DLC compliance).
- Process payments for unlawful goods or services (see Stripe's restricted businesses).
- Reverse-engineer the Service, scrape it, or build a competing product from our codebase.
- Resell access to the Service without written permission.
- Use the Service to harass, defame, or violate the rights of others.
5. Your content + clients
You own everything you put into goldenhour — your client list, your service catalog, your photos, your messages. We hold a limited license to host, process, and display that content as required to operate the Service for you. We do not market your clients to anyone or sell their data.
You're responsible for collecting valid consent from your clients to text and email them. The booking flow captures opt-in at appointment creation; you must honor STOP requests and unsubscribe links.
6. Payments
The Service is offered on a subscription basis (monthly or annual; current pricing on the pricing page). Subscription fees are billed in advance and non-refundable except where required by law.
Payments from your clients flow through your connected Stripe account. Stripe charges its standard processing fees (2.9% + 30¢ online, 2.7% + 5¢ in-person at time of writing). goldenhour does not take a platform commission.
You're responsible for taxes on your business's revenue.
Founding-customer pricing. The first 100 artists to create accounts are enrolled in our founding cohort and locked at the founding subscription rate ($19.99/month at the time of this Terms revision) for the lifetime of the account. Lifetime, here, means: as long as the account is in good standing and the subscription is continuously active. We may raise the published rate at any time for new sign-ups, but we will not raise it for accounts enrolled in the founding cohort. Founding status is recorded on the account at sign-up and surfaced in your billing settings. If you cancel and later return, the prevailing rate at the time of return applies — pause your account instead of canceling if you want to preserve your rate. Founding status does not transfer between accounts and does not survive account deletion.
7. Cancellation + termination
You can cancel your subscription any time from Settings or by emailing hello@goldenhourhq.com. Cancellation takes effect at the end of the current billing period. Your data stays accessible for export for at least 30 days after cancellation.
We may suspend or terminate your account if you violate these Terms (especially payments fraud, SMS spam, or restricted- business activity). For material violations we may act immediately; otherwise we'll give 7 days' notice.
8. Disclaimers
The Service is provided “as is”. We do our best to keep it running and accurate, but we don't warrant that it will be uninterrupted, error-free, or fit for a particular purpose. Stripe and Twilio are independent vendors whose own uptime is outside our control.
9. Liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the subscription fees you paid us in the 12 months preceding the claim. We are not liable for lost profits, lost revenue, or any indirect / consequential damages.
10. Indemnity
You agree to defend and hold us harmless from claims arising out of: your use of the Service, your content, your business operations, your interactions with your own clients, and any violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA. Any disputes will be resolved in the state or federal courts of Miami-Dade County, Florida — except that you may bring small-claims actions in your local jurisdiction.
12. Changes
We may update these Terms. Material changes will be posted here and we'll email account holders at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
